Please review the contractual terms, service obligations, and acceptable usage policies governing your broadband subscription with Giga Network across Wagholi, Lohegaon & Dhanori, Pune.
1. Acceptance of Terms
By registering for, ordering, or utilizing the internet broadband, dedicated optical leased lines, or enterprise network solutions provided by Giga Network (hereinafter referred to as "Company", "We", "Us", or "Our"), you ("Subscriber", "User", or "Customer") agree to be bound strictly by these Terms and Conditions.
If you do not accept these terms in their entirety, you must not subscribe to or access Giga Network services. Continued usage of our services after any documented policy update constitutes explicit consent to the modified terms.
2. Service Provisioning & Feasibility
Service delivery is strictly contingent upon physical optical fiber feasibility, society/building permission, and line-of-sight access in designated operational areas within Wagholi and Pune, Maharashtra.
- Address Verification: Prior to activation, our network engineering team conducts a feasibility audit of your specified location.
- Permission & Access: The subscriber is responsible for providing our installation engineers necessary permission and physical access from society management or building owners to lay optical fiber cables.
- Feasibility Failure: In the event that service cannot be provisioned due to fiber unfeasibility, any advance subscription payments will be refunded in accordance with our Refund Policy.
3. Acceptable Use Policy (AUP)
Subscribers must utilize Giga Network services solely for lawful residential or legitimate business communications as permitted under Department of Telecommunications (DoT) and TRAI guidelines in India.
Reselling or redistributing broadband bandwidth to unauthorized third parties, hosting illegal server nodes, broadcasting pirated material, carrying out cyber attacks, or manipulating network traffic logs.
- Commercial redistribution of residential broadband plans without a written Enterprise Contract is strictly illegal and will lead to immediate account termination.
- Giga Network reserves the right to cooperate fully with law enforcement agencies and regulatory authorities regarding any illegal network activity originated from subscriber IP addresses.
4. Router & CPE Equipment Ownership
Optical Network Terminals (ONT/ONU devices), fiber patch cords, and Dual-Band Wi-Fi routers supplied by Giga Network during connection setup remain the exclusive property of Giga Network unless explicitly purchased by the customer under a separate invoice.
- Subscribers are obligated to maintain company-provided equipment in good physical working condition.
- In the event of service disconnection or subscription cancellation, all company-owned CPE devices must be returned to Giga Network engineers within 7 business days.
- Physical damage due to power surges without lightning arrestors, liquid spillage, or unauthorized device tampering will incur replacement equipment charges.
5. Subscriptions, Renewals & Payments
All broadband plans are billed on a prepaid cycle basis unless an enterprise credit agreement is executed.
- Prepaid Cycle: Monthly, quarterly, semi-annual, or annual subscription fees must be paid prior to the commencement of the billing cycle via our customer portal (ims.giganetwork.in) or authorized UPI channels.
- Grace Period & Disconnection: Failure to renew by the expiry date may result in automatic system suspension of internet access.
- Taxes: All advertised prices are subject to applicable Indian Goods & Services Tax (GST @ 18%).
6. SLA & Service Disruptions
Giga Network strives to deliver 99.9% network uptime SLA over our ring fiber topology in Wagholi, Pune. However, service disruptions may occasionally occur due to scheduled maintenance or third-party fiber cuts.
Scheduled network upgrades are performed during low-traffic windows (typically 02:00 AM – 05:00 AM). Giga Network is not liable for service delays caused by municipal road work fiber damages, extreme weather, or power grid failures beyond reasonable operational control.
7. Limitation of Liability & Jurisdiction
To the maximum extent permitted by Indian law, Giga Network shall not be held liable for indirect, incidental, or consequential damages resulting from temporary internet outages, third-party data loss, or server downtime.
Governing Law & Jurisdiction: These terms shall be governed, interpreted, and enforced in accordance with the laws of India. Any disputes arising under or in connection with these terms shall fall under the exclusive jurisdiction of the competent courts of Pune, Maharashtra, India.
